Terms and Conditions (T&C) – Salomo

1. Provider and Scope
(1) The provider is Felix Mai, sole proprietor, Zeppelinstraße 44, 14471 Potsdam, Germany, e‑mail: info@salomo.world.
(2) These T&C apply to all contracts for the use of “Salomo – Your AI Companion for Dream Reflection” (hereinafter “Salomo”).
2. Subject Matter and Scope of Services
(1) Salomo is an AI-powered app for self-reflection on dreams. Users engage in a structured or open dialogue with an AI-powered system that provides symbol‑ and emotion‑based interpretation prompts, archetype analyses, and visual dream renderings. Content entered is processed using technical pseudonymization.
(2) Salomo is not a medical device, does not provide psychotherapy, and does not make diagnoses within the meaning of the German Psychotherapists Act (§ 1 PsychThG) or the EU Medical Device Regulation.
(3) The service does not include, in particular: medical, diagnostic, or therapeutic services, emergency or crisis intervention, or medication advice.
(4) Availability: The service is generally intended to be available 24/7; technical interruptions (maintenance, outages at third‑party providers) are possible.
(5) Third‑party providers: The following services are used to deliver the service: OpenAI (LLM/generation), Supabase (database, pseudonymized), Stripe (payments). For details, see the Privacy Policy.
3. Requirements for Use
(1) An internet‑enabled device and current web browser or app version are required.
(2) Use is at the user’s own responsibility; Salomo does not replace medical, psychotherapeutic, or other professional help.
4. Trial Period and Conclusion of Contract
(1) 7 days free of charge and without obligation, without providing payment details.
(2) The paid subscription begins only upon entering payment details and expressly subscribing after the trial period ends.
5. Prices and Payment
(1) Subscription prices:
- Weekly: €2.90
- Monthly: €9.90
- Yearly: €59.90
(2) Billed in advance via Stripe.
(3) Current prices are listed in the price overview.
6. Termination
(1) Termination is possible at any time at the end of the current billing period.
(2) Preferably via the Stripe customer portal.
(3) Alternatively by e‑mail to info@salomo.world.
(4) No partial refunds for amounts already paid.
(5) The right to extraordinary termination for good cause remains unaffected; termination pursuant to § 627 BGB is excluded.
7. Right of Withdrawal
(1) Consumers have a 14‑day right of withdrawal.
(2) The right of withdrawal expires if you expressly agree that Salomo will be made available before the withdrawal period ends and acknowledge that the right of withdrawal expires when usage begins (§ 356 (5) BGB).
8. User Obligations
(1) Only content may be transmitted whose disclosure and processing are lawful; in particular, no personal data of third parties without their consent.
(2) Users are responsible for checking what content they share and for verifying the accuracy/suitability of outputs before further use.
(3) Obvious malfunctions or defects must be reported without delay, and technical notes or screenshots provided to clarify the issue.
(4) Users must independently back up any content important to them before deleting it or closing their account.
(5) The provider is not obliged to verify the legality of content.
9. Safety & Emergencies
(1) Salomo does not provide medical advice, diagnoses, or medication recommendations.
(2) In acute crises, please contact emergency services at 112, the medical on‑call service at 116 117, or the telephone helpline at 0800 111 0 111 / ‑222 (24/7).
10. Legal Notices
(1) Salomo is not a medical device, psychotherapy, diagnostic, or treatment service.
(2) No promises of healing or efficacy; no guarantees or obligations to achieve results.
11. Data Protection & Deletion
(1) Processing is in accordance with the GDPR and the Privacy Policy.
(2) When you use the “Delete account” function in the app, all personal data stored about your profile will be deleted immediately in the live systems.
(3) Backups/sub‑processors may technically have up to 30 days’ delay before deletion; data will then be automatically removed.
(4) After deletion, any renewed use will create a new, empty profile.
12. Warranty and Liability
(1) Statutory warranty rights apply.
(2) The provider is liable without limitation for intent and gross negligence, for damages resulting from injury to life, body, or health, and under the German Product Liability Act.
(3) In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations); liability is then limited to the typical, foreseeable damage.
(4) Availability: In the event of downtime or interruptions due to maintenance, force majeure, or third‑party provider disruptions, there is no claim to constant availability or specific response times.
13. Changes to the T&C
(1) Changes will be communicated by e‑mail. If you do not object within 2 weeks, the new terms will be deemed accepted.
14. Special Provisions for the Salomo Affiliate Program
(1) Eligibility: Natural and legal persons aged 18 and over are eligible to participate. Registration as an affiliate is free of charge and requires the complete and truthful provision of all information requested in the registration form. The provider reserves the right to reject applications without stating reasons.
(2) Conclusion of contract: The contract for participation in the affiliate program comes into effect once the provider confirms the affiliate’s registration by e‑mail or via the partner portal.
(3) Advertising materials: Upon successful registration, the provider will supply the affiliate with individual advertising materials (e.g., links, banners, templates). Affiliates may also independently create new advertising materials with creative freedom, provided these comply with legal requirements (in particular the German Medicines Advertising Act and the Act Against Unfair Competition). Advertising materials may only be used in a legally permissible and reputable manner. Unlawful, rights‑infringing, or offensive content is prohibited.
(4) Tracking and cookies: Customer referrals are recorded using tracking links and cookies. Cookies have a lifespan of 365 days. If a qualified purchase occurs within this period, it will be attributed to the affiliate, provided the tracking data was correctly transmitted.
(5) Commission: The affiliate receives a commission of 20% of the net sales price for each valid and completed purchase generated via their affiliate link. Refunded, canceled, or fraudulent orders are not commissionable. The provider may change the commission rate with 30 days’ notice.
(6) Payment: Payments are made from a minimum amount of €10. Payouts are monthly (NET‑30) via the payment method provided by the affiliate in the partner portal (e.g., PayPal). The affiliate is responsible for proper taxation of their income.
(7) Affiliate obligations: The affiliate undertakes to provide a truthful, transparent, and reputable presentation of the “Salomo” offering. Misleading statements or prohibited advertising methods (especially spam) are prohibited.
(8) Termination: Both parties may terminate participation in the affiliate program at any time with 14 days’ notice. In the event of violations of these terms or abusive behavior, the provider may immediately exclude the affiliate.
(9) Liability: The provider is not liable for technical malfunctions or outages that impair the recording or attribution of affiliate links. The affiliate is liable for all third‑party claims arising from unlawful or inappropriate promotion.
(10) Changes: The provider may amend these terms with 14 days’ notice. Continued participation after the effective date constitutes acceptance.
15. Governing Law and Jurisdiction
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For merchants, legal entities under public law, or special funds under public law, Potsdam is the exclusive place of jurisdiction.
16. Final Provisions
(1) Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
